Online Store Terms and Conditions

§ 1 – General Provisions
The online store 4 Łapki i Ogonek, available at https://4lapkiiogonek.com/, is operated by Izabela Gutral-Nowak, conducting unregistered business under the name 4 Łapki i Ogonek.
These Terms and Conditions are addressed to Consumers and define the rules and procedures for concluding a Distance Sales Agreement with the Consumer via the Store.


§ 2 – Definitions

  • Consumer – a natural person concluding an agreement with the Seller through the Store, whose subject is not directly related to their business or professional activity.
  • Seller – a natural person conducting business under the name 4 Łapki i Ogonek.
  • Customer – any entity making purchases via the Store.
  • Entrepreneur – a natural person, legal entity, or organizational unit without legal personality, authorized by separate law, performing business activity in their own name and using the Store.
  • Store – the online store operated by the Seller at https://4lapkiiogonek.com/.
  • Distance Agreement – an agreement concluded with the Customer through a system for concluding distance agreements (via the Store), without the simultaneous physical presence of the parties, exclusively using one or more means of distance communication until the agreement is concluded.
  • Terms and Conditions – these Terms and Conditions of the Store.
  • Order – the Customer’s declaration of intent submitted via the Order Form, aimed directly at concluding a Sales Agreement for Product(s) with the Seller.
  • Account – the Customer account in the Store, containing Customer-provided data and information about Orders placed in the Store.
  • Registration Form – a form available in the Store enabling the creation of an Account.
  • Order Form – an interactive form in the Store allowing the Customer to place an Order, including adding Products to the Cart and specifying the terms of the Sales Agreement, including delivery and payment methods.
  • Cart – part of the Store software where selected Products are visible, and the Customer can modify Order details, including product quantities.
  • Product – a tangible item/service available in the Store that is the subject of a Sales Agreement between the Customer and the Seller.
  • Sales Agreement – an agreement for the sale of a Product concluded between the Customer and the Seller via the online Store. This also includes service agreements and work contracts, depending on the Product’s nature.

  • The Customer may contact the Seller via the contact form on the website or by using the phone number provided above.

§ 4 – Technical Requirements
To use the Store, including browsing products and placing Orders, the Customer needs:

  • a device with internet access and a web browser;
  • an active email account;
  • cookies enabled in the browser.

§ 5 – General Information

  • The Seller is not liable for disruptions or downtime caused by force majeure, unauthorized third-party actions, or incompatibility of the Store with the Customer’s technical infrastructure.
  • Browsing products does not require an Account. Orders may be placed either by creating an Account (§6) or providing personal and address data sufficient for Order processing.
  • Prices are in Polish złoty (PLN) and include VAT.
  • The final price includes the Product price and delivery costs, which are communicated to the Customer during Order placement.
  • For subscriptions or services of indefinite duration, the final price covers all payments for the billing period.
  • If the Product’s nature prevents prior calculation of the final price, information on how the price will be determined, including shipping costs, is provided in the Product description.

§ 6 – Creating an Account

  • To create an Account, fill in the Registration Form with: first name, last name, address, contact phone, and email.
  • Account creation is free.
  • Login requires the username and password set during registration.
  • The Customer can delete the Account at any time without giving a reason and without any fees by contacting the Seller (email or in writing, §3).

§ 7 – Placing an Order
To place an Order, the Customer must:

  1. log in to the Store (optional);
  2. select the Product and add it to the Cart;
  3. log in or place an Order without registration;
  4. if placing an Order without registration – fill in the Order Form with delivery details, select the shipping method, and provide invoice information if different from delivery details;
  5. click “Order and Pay” and confirm via the link sent by email;
  6. choose a payment method and complete the payment within the specified timeframe (§8.3).

§ 8 – Delivery and Payment Methods

  • Delivery methods: courier service, cash on delivery, parcel locker.
  • Payment methods: bank transfer, electronic payments, credit card.
  • Detailed delivery and payment information is available on the Store’s website.

§ 9 – Execution of the Sales Agreement

  • The Sales Agreement is concluded upon the Customer submitting an Order via the Order Form.
  • The Seller confirms receipt and acceptance of the Order by email.
  • Payment must be made within 3 calendar days for bank transfer, electronic payments, or card payments, otherwise the Order will be canceled.
  • For Products with different availability dates, the latest date is used.
  • Delivery is only within Poland.

§ 10 – Right of Withdrawal

  • Consumers may withdraw from the Sales Agreement within 14 days without giving a reason.
  • The period starts upon delivery to the Consumer or designated person.
  • For multiple Products delivered separately, the period starts from delivery of the last item.
  • Withdrawal may be made via email or the Store website.
  • Upon withdrawal, the Seller refunds all payments, including standard delivery costs, within 14 days.
  • The Consumer bears the direct cost of returning the Product.
  • Exceptions to the right of withdrawal include custom-made Products, sealed Products that cannot be returned for hygiene reasons if opened, perishable Products, fully performed services with consent, financial market-dependent Products, and Products inseparably combined with other items.

§ 11 – Complaints and Warranty

  • Sales cover new Products.
  • Complaints are handled according to Polish civil law (warranty provisions).
  • Complaints must be submitted in writing or electronically (addresses in §3).
  • Include a brief description, photos, and Customer details.
  • The Seller responds within 14 days; if not, the complaint is considered justified.
  • Warranty information, if applicable, is included in the Product description.

§ 12 – Out-of-Court Dispute Resolution

  • Consumers may use permanent consumer arbitration courts or contact the regional Trade Inspection for mediation.
  • Free assistance is available from consumer organizations (e.g., Federation of Consumers, Association of Polish Consumers).
  • The EU ODR platform is available: http://ec.europa.eu/consumers/odr/

§ 13 – Personal Data

  • The Seller is the administrator of Customer personal data.
  • Data is collected for Sales Agreement execution and marketing purposes (if consented).
  • Data may be shared with: shipping providers (for delivery) and payment processors.
  • Customers have the right to access and correct their data.
  • Providing personal data is voluntary, but necessary for concluding the Sales Agreement.

§ 14 – Final Provisions

  1. Agreements via the Store are in English.
  2. The Seller may amend these Terms for legal, payment, or delivery reasons, with at least 7 days’ notice.
  3. Polish law applies, including the Civil Code, Electronic Services Act, Consumer Rights Act, and Data Protection laws.
  4. Consumers may use out-of-court dispute resolution methods (EU ODR platform).
